Environment impact assessment (EIA) in Prague

In 1 May 2004 the Act No. 93/2004 Code amending the Act No. 100/2001 Code, on environment impact assessment and amending certain related acts (the Act on Environment Impact Assessment), hereinafter as the Act, became effective. Assessments of activities launched before the Act became effective shall be completed pursuant to the act in which effectiveness they have been started, that is the Act No. 100/2001 Code, or the Act 244/1992 Code on environment impact assessment as amended by the Act No. 132/2000 Code.

The information here below relates to the period from 1 September 2003 to 31 August 2004.

 

Act No. 244/1992 Code

The number of activities subject to the EIA process over the entire period of validity of the Act No. 244/1992 Code on environmental impact assessment, as amended by the Act No. 132/2000 Code, accounted for 110 activities within the responsibility of the OŽP MHMP; of which one assessment process has not been carried out yet because by 31 August 2004 the documentation on was not submitted (see Table).

Within the whole period of validity of the Act No. 244/1992 Code the Ministry of the Environment of the Czech Republic (MOE CR), as the competent authority (for activities pursuant to the Annex No. 1 of the Act) dealt with twenty-two activities on the territory of Prague; of which one EIA process was cancelled upon the investor’s own request and in the case of two activities the EIA process has been ongoing (see Table).

Act No. 100/2001 Code

In the period monitored the OŽP MHMP, as the competent authority, received forty-two notifications (see Table). On the basis of preliminary proceedings of ten EIA processes were terminated concluding the activities should be further assessed pursuant to the Act and thirty-one preliminary proceedings were finished concluding that activities should not be further assessed our the Act.

In the period monitored nine EIA processes were cancelled upon the request of their respective investors, one public hearing was interrupted; five EIA processes were terminated by the issuing of the opinion pursuant to Section 10 of the Act.

Among the projects dealt the prevailing activities were those falling under the point 10.6 of Category II of the Annex No. 1 to the Act (storage and/or business premises including shopping centres, parking facilities, or garages) that is various multipurpose buildings where, besides their business functions shall also provide for functions of administrative building, cultural place, and sports activities (see Table). The classification depending on administrative districts of the City of Prague can be found in Table.

Since the Act became effective, that is from 1 January 2002 to 31 August 2004, the OŽP MHMP received 106 notifications in total.

In the period monitored the MOE CR, as the competent authority, dealt with in total 16 activities on the territory of the City of Prague (see Table 6). In the case of four activities the preliminary procedure was terminated by the conclusion that the activity concerned should be further assessed pursuant to the Act and one preliminary procedure finished with the conclusion that the activity concerned should not be further assessed. No EIA process was cancelled upon an investor’s own request; six processes were finished with the issuing of the opinion pursuant to Section 10 of the Act.

Since the Act became effective, that is from 1 January 2002 till 31 August 2004 the MOE CR, as the competent authority, received eighteen EIA notifications affecting the territory of the City of Prague.

In the period monitored the Regional Authority of the Central Bohemia Region, as the competent authority, dealt with four activities, which affected the territory of the City of Prague. Of this number the EIA process was completed in two cases upon the request of the investor and none of the processes was finished by the conclusion of the preliminary procedure either the statement (see Table). Since the Act became effective till 31 August 2004 the Regional Authority of the Central Bohemia Region has dealt with five activities affecting the territory of the City of Prague.
